BASF has filed two separate lawsuits against Makhteshim Agan of North America, Inc. and its affiliate Control Solutions, Inc., and Cheminova A/S and Cheminova, Inc. for infringing on BASF's patents regarding fipronil. Fipronil is the active ingredient in Regent brand insecticide labeled by BASF for in-furrow use to grow corn and potatoes.
The lawsuits, filed in U.S. District Court in North Carolina, demand the companies give up plans to market generic versions of the product.
Bayer CropScience, which exclusively licenses two of the patents to BASF, is named as an additional plaintiff in the suits.
