Portable container carriers are not tank vehicles
The Federal Motor Carriers Safety Administration (FMCSA) has proposed revisions to its definition of a tank vehicle that would include those hauling portable intermediate bulk containers (IBCs). Commercial driver's license (CDL) holders who operate such vehicles are required to obtain a tank vehicle endorsement. This definition could have a significant impact on the agricultural industry.
ARA recently submitted a comment letter regarding the FMCSA's proposed revision. ARA supports the latest FMCSA proposal not to regulate portable intermediate bulk containers (IBCs) that are empty or filled only with residue. However, ARA does not believe the FMCSA goes far enough and recommends all portable IBCs under 1,000 gallons be excluded from the "tank vehicle" definition, as they do not pose the same safety risks as larger tanks.
