The Executive Order issued by President Obama states that within 90 days, the Secretary of Labor shall identify any changes that need to be made in the retail and commercial grade exemptions in the Process Safety Management (PSM) Standards. 

If the “change” is adopted, an overwhelming majority of ag retailers will be forced to comply with PSM standards that are more designed for chemical manufacturing facilities than retail operations. The “retail exclusion” from PSM standard applicability was proposed by OSHA (in the proposed PSM standard) and is not a statutory mandate of the Occupational Safety and Health Act  According to OSHA, in the final rule preamble, “Additionally, OSHA proposed to exclude retail facilities".
